AmarBari.in is an Independent Property Information & Listing Platform operating from Serampore, Hooghly – 712223, West Bengal, India. We are NOT a Property Dealer, Real Estate Broker, Real Estate Agent, Builder, Promoter, Developer, or RERA Registered Real Estate Agent. Our platform facilitates property information dissemination, property listings, property advertising, lead generation, property introduction, and visit coordination for residential and commercial properties including Flats, Apartments, Independent Houses, Villas, Land, Plots, Shops, Office Spaces, Warehouses, Godowns, PG accommodations, Rental Properties, and Properties for Sale.

Changes to These Terms

We reserve the right to modify, amend, or update these Terms of Service at any time at our sole discretion. Material changes will be communicated to registered users via the email address associated with their account or through a prominent notice on our platform. The "Last Updated" date at the top of this document will reflect the most recent revision. Your continued use of AmarBari.in following the posting of revised Terms constitutes your unconditional acceptance of such changes. If you do not agree to the modified Terms, you must discontinue use of the platform immediately.

User Responsibilities

As a user of AmarBari.in, you are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to provide accurate, current, truthful, and complete information during registration and in all communications with the platform. You must promptly update your account information to maintain its accuracy. You are responsible for any consequences arising from the provision of false, misleading, or incomplete information. You agree to use the platform only for lawful purposes consistent with these Terms and all applicable laws of India.

Acceptable Use Policy

You agree to use AmarBari.in solely for legitimate property information discovery, listing, and related communication. Acceptable use includes browsing property listings, submitting genuine property inquiries, advertising properties you are legally authorized to offer, and coordinating property visits through the platform. You must not interfere with or disrupt the platform's servers, networks, security systems, or technical infrastructure. You shall not attempt to gain unauthorized access to any part of the platform, other user accounts, or computer systems connected to AmarBari.in.

Prohibited Activities

The following activities are expressly prohibited on AmarBari.in and constitute a material breach of these Terms: posting fake, misleading, duplicate, unauthorized, fraudulent, illegal, or spam listings; uploading malicious code, viruses, or harmful software; impersonating any person, entity, or AmarBari.in representative; scraping, data mining, or systematically extracting platform content without prior written authorization; violating any applicable Indian law including the Information Technology Act, 2000 and Indian Penal Code; facilitating money laundering, fraud, or any criminal activity; harassing, abusing, or harming other users; and circumventing any platform security or access control measures.

User Representations

By accessing or using AmarBari.in, you represent and warrant that: (a) you are at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872; (b) all information you provide to the platform is true, accurate, current, and complete; (c) you have the legal right and authority to post any property listing you submit and such listing does not violate any third-party rights; (d) your use of the platform does not violate any applicable law, regulation, or court order; and (e) you are not impersonating any other person or entity.

User Verification Policy

AmarBari.in reserves the right to request identity documents, ownership proof, authorization documents, or any other relevant verification materials from users whenever reasonably necessary for fraud prevention, platform integrity, regulatory compliance, or investigation of suspicious activity. Failure to provide requested verification documents within a reasonable timeframe may result in account restriction, listing suspension, or termination of platform access. All documents submitted for verification shall be handled in accordance with our Privacy Policy.

Account Suspension or Termination

We reserve the right, at our sole discretion and without liability, to suspend, restrict, or terminate your account and access to AmarBari.in at any time, with or without prior notice, for any reason including but not limited to: breach of these Terms of Service, provision of false or misleading information, engagement in prohibited activities, violation of applicable laws, or any conduct that we reasonably believe harms the platform, its users, or its reputation. Upon termination, your right to access the platform ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, indemnification, and limitations of liability.

Platform Service Charges

AmarBari.in charges Platform Service Charges ranging from ₹499 to ₹999 (Indian Rupees) for certain platform services including lead generation, property introduction, and visit coordination. These charges are Platform Service Charges only and are expressly NOT brokerage commissions, agency fees, consultancy charges, success fees, or any form of real estate intermediary remuneration. AmarBari.in does not participate in, facilitate, or receive any commission from property transactions. The applicable service charge amount will be clearly displayed before you confirm any paid service. All charges are inclusive of applicable taxes unless stated otherwise. We reserve the right to modify our service charge structure with reasonable prior notice.

Refund Policy

All Platform Service Charges paid to AmarBari.in are non-refundable, except where a refund is required under applicable law. Once a service charge is processed and the corresponding service (such as lead introduction or visit coordination) is initiated, no refunds shall be issued, including for change of mind, inability to finalize a property transaction, property unavailability discovered after introduction, or dissatisfaction with introduced leads. By proceeding with payment, you acknowledge and accept the non-refundable nature of our platform service charges. This policy is subject to applicable Indian consumer protection laws, and nothing in this clause affects any statutory rights that cannot be waived by agreement.

Lead / Property Introduction Validity

Any lead introduction, property introduction, or visit coordination service provided by AmarBari.in carries a validity period of 48 hours from the time of introduction. Users are expected to act upon the introduced lead or property information within this 48-hour window. AmarBari.in does not guarantee that the introduced property or lead will remain available beyond this validity period. The platform shall not be held responsible for any change in property status, pricing, availability, or owner/seller circumstances occurring after the 48-hour validity window.

Anti-Bypass Policy

If any user intentionally bypasses AmarBari.in after being introduced through the platform to avoid applicable Platform Service Charges, AmarBari.in reserves the right to suspend access to its services and pursue remedies available under applicable Indian law.

Third-Party Links Disclaimer

AmarBari.in may contain links to external websites, applications, or resources that are not owned, operated, or controlled by us. We do not endorse, monitor, verify, or assume responsibility for the accuracy, completeness, legality, safety, or availability of any content, products, services, or practices on such third-party platforms. Your access and use of any third-party linked sites is entirely at your own risk. We encourage you to review the terms of service and privacy policies of any third-party platforms you visit. AmarBari.in shall not be liable for any loss, damage, or harm arising from your use of or reliance on any third-party content or services.

While we strive to maintain a reliable platform, AmarBari.in makes no representations, warranties, or guarantees regarding the accuracy, completeness, reliability, or timeliness of any property listing information including but not limited to square footage, built-up area, carpet area, super built-up area, property dimensions, pricing, availability, ownership status, legal title, regulatory approvals, building permits, occupancy certificates, RERA registration status, property condition, or amenities. All listing information is provided on an "as available" basis. Independent professional verification by qualified legal, technical, and financial advisors is essential before entering into any property transaction.

All intellectual property rights in and to AmarBari.in, including but not limited to the website design, source code, software, databases, text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, trademarks, service marks, trade dress, and the overall "look and feel" of the platform, are owned by or licensed to AmarBari.in and are protected under Indian copyright, trademark, and intellectual property laws, as well as applicable international treaties. All rights not expressly granted to users under these Terms are expressly reserved by AmarBari.in. Indemnification

You agree to defend, indemnify, and hold harmless AmarBari.in, its founders, directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms of Service; (b) your use or misuse of the platform; (c) any property listing, content, or material you submit, post, or transmit through the platform; (d) your violation of any applicable law, regulation, or third-party right; (e) any dispute or transaction between you and any other user; or (f) any fraudulent, negligent, or intentional misconduct on your part. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Disclaimer of Warranties

AMARBARI.IN AND ALL CONTENT, SERVICES, AND FEATURES AVAILABLE THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, AMARBARI.IN EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, SECURITY, AND FREEDOM FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

Limitation of Liability

To the maximum extent permitted by applicable Indian law, AmarBari.in, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, loss of business opportunities, business interruption, personal injury, property damage, or emotional distress, arising out of or in connection with: (a) your use or inability to use the platform; (b) any property transaction, communication, or interaction with other users; (c) any content, information, or listings accessed through the platform; (d) any errors, omissions, or inaccuracies in platform content; or (e) any other matter related to these Terms or the platform, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if AmarBari.in has been advised of the possibility of such damages. The total aggregate liability of AmarBari.in, whether in contract, tort, or otherwise, shall be limited to the extent expressly provided under applicable Indian law and shall not exceed the total Platform Service Charges paid by you to AmarBari.in during the twelve (12) months immediately preceding the event giving rise to the claim.

Force Majeure

AmarBari.in shall not be liable for any failure or delay in the performance of its obligations under these Terms of Service if such failure or delay arises from or is attributable to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters (floods, earthquakes, cyclones, fires), epidemics, pandemics, public health emergencies, war, terrorism, civil unrest, riots, strikes, lockouts, labor disputes, government actions, regulatory changes, judicial orders, internet or telecommunications failures, power outages, cyber attacks, hacking incidents, server failures, denial of service attacks, or any other event that could not have been reasonably foreseen or prevented by AmarBari.in. In the event of a force majeure condition, our obligations under these Terms shall be suspended for the duration of such condition, and we shall be entitled to a reasonable extension of time for performance.

Severability

If any provision or part of a provision of these Terms of Service is determined by a court of competent jurisdiction to be invalid, illegal, unenforceable, or void under applicable Indian law, such provision or part shall be deemed severed from these Terms, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law. The invalid or unenforceable provision shall be deemed modified or interpreted to the minimum extent necessary to render it valid and enforceable while preserving the original intent of the parties as closely as possible.

Waiver

No failure, delay, or omission by AmarBari.in in exercising any right, power, or remedy under these Terms of Service shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any further or other exercise thereof. Any waiver of a breach of any provision of these Terms shall not be deemed a waiver of any subsequent breach of the same or any other provision. No waiver shall be effective unless it is in writing and signed by an authorized representative of AmarBari.in.

Entire Agreement

These Terms of Service, together with our Privacy Policy, Cookie Policy, Refund Policy, and any other policies or agreements expressly incorporated by reference herein, constitute the entire agreement between you and AmarBari.in concerning your use of the platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to the subject matter hereof. No modification, amendment, or alteration of these Terms shall be binding unless in writing and duly executed by AmarBari.in.

Governing Law

These Terms of Service, and all matters arising out of or relating to these Terms or your use of the platform, shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

Dispute Resolution

AmarBari.in is committed to resolving disputes amicably and efficiently. In the event of any dispute, controversy, or claim arising out of or relating to these Terms of Service or the platform, the parties shall first attempt to resolve the matter through good-faith informal discussions. Either party may initiate such discussions by sending a written notice to the other party describing the dispute and proposing a resolution. If the parties are unable to resolve the dispute within thirty (30) days of such notice, either party may pursue legal remedies as provided under applicable Indian law. We strongly encourage users to contact us directly to discuss any concerns before initiating formal legal proceedings.

Exclusive Jurisdiction

Subject to the dispute resolution provisions above, the parties hereby irrevocably submit to the exclusive jurisdiction of the competent courts at Serampore, Hooghly, West Bengal, India, for the resolution of any disputes, claims, or legal proceedings arising out of or in connection with these Terms of Service or your use of the platform. You waive any objection to the laying of venue in such courts on grounds of forum non conveniens or any similar doctrine.

Fraud Prevention Notice

Platform Misuse Policy

Any attempt to manipulate platform features including reviews, ratings, search rankings, listing visibility, lead counts, or any algorithm-driven functionality is strictly prohibited. This includes using bots, automated scripts, fake accounts, coordinated voting, or any artificial means to influence platform metrics. Violation of this policy constitutes a material breach and may result in immediate account termination, listing removal, and legal action.

Listing Review Policy

AmarBari.in reserves the absolute right to review, edit, reject, suspend, unpublish, or permanently remove any property listing, user submission, or account at any time, with or without prior notice, if such listing or account is found to be in violation of these Terms of Service, our listing guidelines, or applicable Indian law. Reasons for listing review or removal include but are not limited to: submission of false or misleading information, duplicate listings, unauthorized listings posted without owner consent, suspicious activity, user complaints, legal or regulatory requirements, or any action that we reasonably believe compromises platform integrity or user safety.

Listing Removal Policy

In addition to the Listing Review Policy, AmarBari.in may remove listings that: are reported as fraudulent or misleading by users or authorities; contain outdated or unavailable property information; violate intellectual property rights of third parties; are posted in incorrect categories to manipulate visibility; contain prohibited content as defined in these Terms; or are subject to a valid legal or regulatory takedown request. Users may report questionable listings by contacting us at info@amarbari.in. We endeavor to review and act upon valid reports promptly.

User Generated Content Policy

By submitting, posting, uploading, or displaying any content on AmarBari.in, including but not limited to property listings, descriptions, photographs, videos, reviews, ratings, comments, messages, and any other material ("User Content"), you grant AmarBari.in a non-exclusive, worldwide, royalty-free, sub-licensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and perform such User Content in connection with operating, promoting, and improving the platform. You represent and warrant that you own or have all necessary rights, licenses, consents, and permissions to grant the foregoing license and that the User Content does not infringe any third-party intellectual property rights, privacy rights, or any other legal rights.

Notice and Takedown Procedure

In compliance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, AmarBari.in has established a Notice and Takedown procedure for reporting content that is alleged to be infringing, illegal, defamatory, obscene, or otherwise in violation of applicable law. To submit a takedown notice, please send a detailed communication to info@amarbari.in containing: (a) identification of the specific content complained of with URL or sufficient detail to locate it; (b) a description of the alleged violation or infringement; (c) your contact information including name, email, and phone number; (d) a statement of good-faith belief that the content is unlawful or infringing; and (e) a physical or electronic signature. Upon receipt of a valid notice, we shall acknowledge it within thirty-six (36) hours and endeavor to resolve the matter expeditiously in accordance with applicable law.
